being accused of running a stop sign/second violation?
I just got a ticket for supposedly running a stop sign in Alabama. I got my first ticket as a speeding ticket for going i think 40-44 in a 25pm hour zone around 12:00pm late November ( but I can’t remember the year). It was my first violation (2 point infraction). I went to court and paid ticket and I think court cost. I did not have a lawyer or a public defender. I remember the judge telling me to go to driving school one Saturday and it would be off my record. I was pulled over again around 1:00am in the morning 9/28/2008. Supposedly I had ran a stop sign that is hard to see in the dark. When I look back to see the stop sign in the morning time it is easy to see, but it looks like it should have been where the road curves to meet the other one. I told the officer I was about to pull into the apartments which was just two seconds down the street to the left of me. He asked if I had been down that road before. Not really thinking I said yes. He said well I cannot use that as an excuse. Ok maybe because I was not in court I could have lied to him and say no I had not, and he would have let me off the hook. He told me he had already gotten 5 people that night .However, I don’t know what their excuse was. One problem is that I have some headlights that are messed up in the back because the taillight was broken, so I don’t know if he pulled me over because of that. I have been told that if they pull people over who live in that neighborhood that live there or on that street that they let them go. I tried to tell the officer that I thought I had, at the intersection where the road curves to meet the other road. This would be not because I think From Alabam that I stopped there because the sign should have been at that location but I had stopped there before just because i was use to stopping there. I guess I should have kept my mouth shut, because I told him if I had stopped in the past it was because I had to sop anyways because there was a car in front of me that had stopped, I could see a car coming from the right from the street behind me, or there would be a car turning going straight where i couldn’t turn left. Looking at the street its difficult to determine what signs are for what people. The stop sign is a bit low with some shrubbery hanging over it, so it is difficult to see. So it seems like the officer knows it is hard to see, so if somebody told him that it was their first time down that road that he could understand why somebody would make the mistake. It also seems like I should have acted like i had acknowledged that it was there and told him I stopped. I didn’t say oh yes you are absolutely right I did not stop at that stop sign, nor did I say you are absolutely wrong I did stop at that stop sign. I think I said something more on the lines of I did not see a stop sign but I though I had stopped at the intersection of where that road was leading to the road where I wanted to left onto. I was given a ticket that had my infractions and a yellow sheet with how much it cost. I was told I could go to court on Nov 3 at 2:00pm but I did not have to show up to court to pay the ticket. It sounds like I could pay it before hand and avoid court cost. I know this seems like the cheaper deal at first, but should I pay more and get a traffic lawyer to see if I can get the ticket dismissed and get it off of my insurance or should I just wait till nov 2nd and get a public defender or just go in front of the judge and do what ever plea is best. I understand if I have to pay the ticket and maybe court cost and at the most community service. If I can get out of paying for then that is great. I think the main thing that I am worried about is that my insurance might go up. I am 26 year old female . I will be 27 in January. My car is under an umbrella plan that my dad has. I give my dad a check each month for what he says I owe. He doesn’t even know I got the infraction. Supposedly its a 3 point infraction and a criminal offense in Alabama, not a civil offense like some states. I would think that my part of the insurance would go up for the car I was driving, I just hope all of them do not go up because me. I just think he would find out something is wrong if all of a sudden it had gone up. So, I am really hoping that my insurance will not be affected. I was told to get a lawyer, not a public defender, because there is a strong chance that they can help me get it off of my driving record or even if it stays on my record, my insurance will not be affected. I have traveler’s company insurance. Does anybody know how much somebody’s insurance can go up if they are a female 26 years of age at the time of incident. Its their second incident within 5 years? Is it really necessary to even appear in court on the court date or higher a lawyer to contest it, or should I just pay off the ticket have it on my driving record and have no way of insurance going up at all? My friend told me its better to pay a lawyer up front $200oh yeah sorry about mentioning about certain ideas more than one time. typing this in the wee hours of the morning.
